Federal Court of Australia fines Emirates $10 million for price fixing.
The Federal Court in Sydney has just announced a $10 million fine levied against Emirates for “engaging in cartel conduct in breach of the Trade Practices Act 1974, now known as the Competition and Consumer Act 2010.”
The penalty relates to alleged price fixing of fuel and other surcharges, with Emirates the tenth carrier to settle in the proceedings, which have so far resulted in fines totalling $68 million.
Proceedings against the carrier for the charges began in 2009 and were initiated by the ACCC.
Further to the $10m penalty, Emirates has been ordered to pay $500,000 toward the ACCC’s litigation costs.
Proceedings are also underway against Garuda Indonesia following the carrier’s failure to secure foreign state immunity from Australia’s High Court.
